Karola Szajnochy 11, 85 – 738 Bydgoszcz, entered into the register of entrepreneurs of the National Court Register maintained by the District Court in Bydgoszcz, 13th Commercial Division of the National Court Register under KRS number 0000048943, NIP: 5540310451, REGON: 091109499, share capital PLN 3,632,000.00 paid in full.

II What is the Newsletter service?

The Newsletter is an electronic service provided by MODUS via e-mail, consisting of automatic transmission by MODUS, to users registered for this electronic service, of cyclical information about products, new products and promotions in the online store: modus.com.pl (Online Store), i.e. commercial information for direct marketing purposes.
The Newsletter service is provided free of charge for an indefinite period.

III How to use the Newsletter service?

You can use the Newsletter:

  • 1) after providing your e-mail address and name and confirming your subscription,
  • 2) when placing an order in the Online Store and when creating an account in the Online Store by selecting the available subscription option.

After subscribing to the Newsletter service, you will need to accept the provisions of these regulations by clicking on the activation link sent by MODUS to the e-mail address provided by you. Clicking on the activation link is tantamount to concluding an agreement for the provision of electronic services between you and MODUS.

IV What are the technical requirements necessary to use the Newsletter service?

Using the Newsletter is possible provided that the IT system you use meets the following minimum technical requirements:

  • 1) computer, laptop or other multimedia device with Internet access,
  • 2) access to e-mail,
  • 3) Internet browser in the current version: Mozilla Firefox; Internet Explorer; Opera; Google Chrome; Safari or Microsoft Edge,
  • 4) recommended minimum screen resolution: 1024×768,
  • 5) active option to save Cookies and support Javascript in the web browser.

V Can you use materials sent via the Newsletter?

We inform you that exclusive rights to all elements (photos, graphics, written texts, video images, etc.) sent via the Newsletter, including works within the meaning of the Copyright and Related Rights Act of February 4, 1994, in particular copyright, are held exclusively by MODUS. You may use the materials contained in the Newsletter only for your own personal use and only for the proper use of the Newsletter.

VI How to unsubscribe from the Newsletter service?

You may withdraw from the contract regarding the Newsletter service within 14 days of its conclusion. In addition, you may at any time and without giving a reason, resign from the Newsletter by sending an appropriate request to MODUS, in particular via e-mail to the address: kontakt@modus.com.pl or in writing to the address: MODUS S.A., ul. Karola Szajnochy 11, 85 – 738 Bydgoszcz.
MODUS has the right to terminate the Newsletter agreement with a one-month notice period for important reasons, understood as:

  • 1) change in the law regulating the provision of services by electronic means affecting the mutual rights and obligations specified in the agreement;
  • 2) change in the method of providing services caused solely by technical or technological reasons;
  • 3) change in the scope or provision of services to which the provisions of the regulations apply, by introducing new, modifying or withdrawing by MODUS the existing functionalities or services covered by the regulations.

VII How to file a complaint about the Newsletter service?

You can file a complaint to MODUS in connection with the use of the Newsletter service. The complaint may be submitted electronically and sent to the following address: kontakt@modus.com.pl or in writing to the following address: MODUS S.A., ul. Karola Szajnochy 11, 85 – 738 Bydgoszcz.
In the complaint, you should include a description of the problem. MODUS will promptly, but no later than within 14 days, consider the complaint and provide you with an answer.

VIII How should you use the Newsletter service?

When using the Newsletter service, you are obliged to respect the principles of social coexistence, good customs and generally applicable legal regulations, personal rights and intellectual property rights of MODUS and third parties. When using the Newsletter, you may not provide or transmit content prohibited by applicable law, or post content of an illegal nature.

IX Will we process your personal data?

Using the Newsletter requires providing personal data – your name and e-mail address.
By signing up for the Newsletter, you consent to the processing of your personal data by MODUS as the administrator of personal data for the purpose of sending the Newsletter. Providing your personal data is voluntary, but necessary to use the Newsletter. You have the right to access your personal data, including requesting a copy, requesting rectification, limiting the processing or deletion of your data and resigning from the Newsletter service, transferring your personal data, e.g. to another administrator, filing a complaint with the President of the Personal Data Protection Office.

X Final provisions

  • 1) These Regulations are available free of charge on the modus.com.pl website. The Regulations can be saved by downloading them in pdf file format. and saving it in the device’s memory or printing it out.
  • 2) MODUS has the right to change the regulations. The change in the regulations does not in any way violate the rights acquired before the date of entry into force of the regulations. The changed regulations are binding on you if, after being notified of the change, you do not terminate the agreement for the provision of the Newsletter service between us within 14 calendar days from the date of notification.
  • 3) In matters not regulated by the regulations, the provisions of generally applicable law shall apply, including in particular the provisions of the Civil Code and the Consumer Rights Act.
  • 4) These regulations shall apply from 11.12.2024.
