Dear Customer! We are glad that you decided to take advantage of our offer. These Regulations specify, among other things, the rules for placing orders, available payment and delivery methods and your rights as a consumer related to returns and complaints about goods and services that you can purchase in our Online Store.

We receive telephone calls and e-mails on working days from Monday to Friday between 8:00 and 16:00.
These Regulations have been drawn up to protect your rights, while respecting consumer protection regulations. In the event that any of the provisions of these Regulations are contrary to generally applicable legal regulations, this provision shall be considered invalid, and generally applicable legal regulations shall apply in its place (which shall not render the remaining provisions of these Regulations invalid). By placing an Order, you accept the terms of the Regulations, so before placing an Order, please read them carefully.
At the same time, we indicate that the Goods in our Online Store are Goods intended for public officials – Police, Army, Fire Department, Border Guard.

I General Provisions

- 1.1. In order to better understand the provisions of these Regulations, we indicate below the definitions of terms used in the Regulations:

Customer A natural person with full legal capacity or a legal person or an organizational unit without legal personality, to which the law grants legal capacity, who has concluded or intends to conclude a Sales Agreement or an Agreement for the provision of electronic services with the Seller Seller Modus joint-stock company, with its registered office in Bydgoszcz, ul. The Regulations specify in particular:
- 1.2.1. principles of concluding Distance Selling Agreements between the Seller and the Customer via the Online Store,
- 1.2.2. principles of providing Electronic Services to Customers by the Seller as specified in the Regulations.
- 1.3. Information regarding Goods in the Online Store does not constitute an offer within the meaning of the provisions of the Civil Code. By placing an Order, the Customer makes an offer to purchase a specific Good under the terms specified in its description.
- 1.4. Using the Online Store is possible provided that the IT system used by the Customer meets the following minimum technical requirements:
- 1.4.1. computer, laptop or other multimedia device with Internet access,
- 1.4.2. access to e-mail,
- 1.4.3. Internet browser in the current version: Mozilla Firefox; Internet Explorer; Opera; Google Chrome; Safari or Microsoft Edge,
- 1.4.4. recommended minimum screen resolution: 1024×768,
- 1.4.5. active cookie storage and Javascript support in the web browser.
II Rules of using the online store

- 2.1. In the online store, the Customer may purchase Goods and use Electronic Services.
- 2.2. Placing an Order in the online store is possible both after registering an Account and without registering an Account.
- 2.3. Only persons over 18 years of age may use the online store.
- 2.4. Goods in the online store are marked in detail. The website contains, among other things, information about the properties of the Goods, their price, the material from which they are made. The Seller indicates that the color of the Goods may vary depending on the screen and its settings on the device the Customer uses when placing an Order in the online store. This difference does not constitute a non-conformity of the Goods with the Sales Agreement.
- 2.5. The Seller allows you to place an Order for personalized Goods, which will be made according to the Customer’s specifications.
III Orders
- 3.1. In order to place an Order, the Customer must select the Goods marked as available and their variant from the options available for a given Good in the Online Store. All Goods presented in the Online Store are new.
- 3.2. Exceptionally, in the event of simultaneous Orders for the same Goods placed by several Customers, it may happen that the selected Goods will not be available. In such a situation, the Customer will be informed that their Order cannot be fulfilled.
- 3.3. The selection of the Goods is made by adding the Goods to the basket.
- 3.4. In addition to the type and quantity of ordered Goods and data on the selected delivery and payment method, the Customer is required to provide data in the Order Form, such as: name and surname, delivery address, e-mail address and phone number. For this purpose, the Customer must follow the displayed messages and information on the website of the Online Store.
- 3.5. Placing an Order will be possible after accepting the provisions of the Regulations, providing personal data marked as mandatory and accepting the Privacy Policy. Filling out the Order Form completed by selecting the option “I order and pay” (or another confirming the order with the obligation to pay) means placing an Order.
- 3.6. After receiving the Order, the Seller sends the Customer an Order Confirmation to the e-mail address provided by the Customer when placing the Order. At the time of sending the Order Confirmation, a Sales Agreement is concluded between the Customer and the Seller. The content of the concluded Sales Agreement is recorded, secured and made available to the Customer by making these Regulations available on the website of the Online Store, sending the Customer an Order Confirmation and sending the Customer a sales document. The content of the Sales Agreement is additionally recorded and secured in the Seller’s computer system.
- 3.7. The Sales Agreement is concluded in Polish.
- 3.8. At any stage of placing an Order, until payment is made, the Customer may cancel the Order by leaving the subpage used for placing Orders. An Order, the placing process of which is not completed by the Customer, is considered canceled.
- 3.9. An invoice documenting the conclusion of the Sales Agreement will be sent to the Customer to the e-mail address provided by the Customer when placing the Order. The Customer authorizes the Seller to send the invoice electronically to the e-mail address provided by the Customer, unless the Customer expressly notifies the Seller of the desire to receive it in paper form.
- 3.10. In the event of documenting the Sales Agreement with a receipt, it will be attached to the Goods.
- 3.11. The Seller has the right to change the prices of the Goods, introduce and withdraw Goods, grant discounts on individual Goods and conduct and cancel promotional and sale campaigns.
IV Prices and payment
- 4.1. The price of the Goods in the Online Store is given in Polish złoty and is a gross price (includes tax on goods and services). Prices do not include delivery costs and any costs resulting from the payment method chosen by the Customer. The total cost of the Order, with all fees, will be transferred to the Customer at the time of placing the Order after he has selected the delivery and payment method.
- 4.2. The Seller provides the Customer with the following payment methods:

Cash on delivery The indicated payment method is available only for Orders with a delivery location in Poland, excluding personalized Goods Payment via the Przelewy24 payment service The Service is operated by PayPro S.A. with its registered office in Poznań (registered office address: ul. Pastelowa 8, 60-198 Poznań), entered into the Register of Entrepreneurs of the National Court Register under number 0000347935, registration files kept by the District Court of Poznań – Nowe Miasto and Wilda in Poznań, share capital of PLN 4,737,100.00, fully paid up, NIP: 7792369887. In the case of payment via an electronic payment system, the Customer makes the payment before the Order is processed. The electronic payment system allows you to make a payment using a credit card or a quick transfer from selected Polish banks. Payment using the Przelewy24 Installments method A service provided by PayPro S.A. with its registered office in Poznań, which allows you to pay in installments. The possibility of choosing this payment method may depend on the value of the Order. The Customer who decides to use this form of payment must agree to the transfer of their personal data, including payment history, to the crediting entity. Detailed rules and conditions for the provision of this service are specified on the website of the service operator: https://www.przelewy24.pl/ . Installment payment is a consumer credit serviced and provided by a third party, the availability of which depends on the credit decision made by that third party. Payment by gift card Payment by gift card is made by entering the Gift Card code in the Order Form in the designated place. - 4.3. The Seller does not accept traditional transfers, therefore the Customer will not be informed of the bank account number for making such a transfer.
- 4.4. Depending on the payment method chosen by the Customer, additional conditions or fees may apply, which will be presented to the Customer at the time of placing the Order.
- 4.5. In the case of payment via the Przelewy24 payment service, the Customer is obliged to make the payment immediately, but no later than within 24 hours of placing the Order and receiving from the Seller a link to payment in an authorized service.
- 4.6. In the case of payment using the Przelewy24 Installments method, the Customer is obliged to repay monthly installments based on the schedule agreed with the crediting entity. Repayment of installments is made directly between the Customer and the crediting entity.
- 4.7. In the case of payment on delivery, the Customer is obliged to make the payment upon receipt of the shipment.
- 4.8. The Customer selects one of the above-mentioned payment methods by checking the appropriate box in the Order Form, with the exception that the selection of payment by cash on delivery is only possible for delivery within Poland.
- 4.9. In the event that the Customer fails to pay within the deadlines specified in points 4.5. and -4.7. above, the Seller has the right to withdraw from the agreement without setting the Customer an additional deadline for payment. In such a case, the Customer will receive an e-mail about the cancellation of the Order, which means the Seller has withdrawn from the agreement.
V Delivery
- 5.1. Information on delivery costs is displayed in the Order Form next to the available delivery methods. Delivery costs are borne by the Customer, subject to point 5.2. below.
- 5.2. If the value of the ordered Goods exceeds PLN 300.00 (excluding delivery costs and costs related to the selected payment method) – the delivery costs are covered by the Seller (the Customer does not bear the delivery costs).
- 5.3. The delivery time of the Goods to the Customer is up to 5 Business Days, unless the Seller indicated a longer period in the description of the given Goods or when placing the Order. The Seller also reserves the right to indicate a longer delivery time in the Order Confirmation.
- 5.4. The Seller provides the Customer with the following delivery methods:
- 5.4.1. Priority registered letter (applies only to deliveries outside Poland),
- 5.4.2. Courier shipment, cash on delivery courier shipment.
- 5.4.3. Parcel locker shipment, pick up point
- 5.5. The Seller does not territorially limit the delivery of Goods, however, in the case of delivery outside the territory of the European Union Member States, the Customer may be required to pay customs duties.
- 5.6. The delivery address for the Goods indicated by the Customer in the Order Form is the place of fulfillment by the Seller.
- 5.7. The delivery period runs from the moment the Order Confirmation is sent to the Customer.
VI Withdrawal from the contract
- 6.1. A consumer who has concluded a sales contract with the Seller may withdraw from it without giving a reason within 14 days from the date of delivery of the Goods. To meet the deadline, it is sufficient to send a statement of withdrawal from the sales contract before its expiry. The period for withdrawal from the sales contract begins on the date of delivery of the Goods (i.e. from the date of taking possession of the Goods by the Consumer or a third party indicated by him other than the carrier). If the contract covers many Goods that are delivered separately, in batches or in parts, the period for withdrawal from the contract begins on the delivery of the last Goods, their batch or part.
- 6.2. In accordance with the Consumer Rights Act, the Consumer does not have the right to withdraw from the contract in relation to personalized Goods.
- 6.3. The Consumer may submit a declaration of withdrawal from the contract in any form, for example by sending a withdrawal form, the template of which constitutes Annex No. 1 to the Regulations. The Consumer should submit a declaration of withdrawal from the Sales Agreement to the Seller:
- 6.3.1. in writing to the Seller’s address, i.e. MODUS S.A., ul. Karola Szajnochy 11, 85 – 732 Bydgoszcz,
- 6.3.2. via e-mail to the following address: sprzeda@modus.com.pl,
- 6.4. In the event of withdrawal from the Sales Agreement, the Consumer is obliged to return the Goods to the address indicated in point 6.3.1., immediately, but no later than 14 days from the date on which he withdrew from the Sales Agreement.
- 6.5. After receiving a declaration of withdrawal from the Sales Agreement, the Seller shall return all payments made by the Consumer, including the cost of delivery, within 14 days of receiving the declaration. If the Consumer has chosen a method of delivery of the Goods other than the cheapest standard method of delivery offered by the Online Store, the Seller is not obliged to refund the additional costs incurred by him.
- 6.6. The Seller may withhold the return of these payments until the Goods are received or until the Seller is provided with proof of their return, depending on which event occurs first. The payment is returned using the same method of payment that was used by the Consumer in the original transaction, unless the Consumer has expressly agreed to another solution that does not involve any costs for him. In particular, if the payment for the Goods was made by the Consumer by cash on delivery, the payment may be returned to the bank account number indicated by the Consumer.
- 6.7. In the event of withdrawal from the Sales Agreement, it is considered not to have been concluded. Withdrawal from the Sales Agreement by the Consumer making the payment using the Przelewy24 Installments method is tantamount to withdrawal from the consumer credit agreement granted to the Consumer in connection with the Sales Agreement by the entity granting the consumer credit.
- 6.8. The Consumer shall bear only the direct costs of returning the Goods to the Seller.
- 6.9. The Consumer shall be liable for the decrease in the value of the Goods resulting from using them in a way that goes beyond what is necessary to determine the nature, characteristics and functioning of the Goods.
VII Non-conformity of the Goods with the Sales Agreement
- 7.1. The Seller shall be liable to the Consumer for the lack of conformity of the Goods with the Sales Agreement. The basis and scope of the Seller’s liability to the Consumer for the lack of conformity of the Goods with the Sales Agreement is specified in the Consumer Rights Act.
- 7.2. The Seller is liable to the Consumer for the lack of conformity of the Goods with the Sales Agreement existing at the time of delivery of the Goods and revealed within 2 years from that time.
- 7.3. In the event that the Goods are inconsistent with the Sales Agreement, the Consumer has the right to file a complaint:
- 7.3.1. in writing to the Seller’s address, i.e. MODUS S.A., ul. Karola Szajnochy 11, 85 – 738 Bydgoszcz,
- 7.3.2. via e-mail to the following address: Sprzedaz@modus.com.pl.
- 7.4. In the message filing the complaint, the Consumer should provide as much information and circumstances as possible regarding the subject of the complaint and contact details, as well as specify their claims related to the non-conformity of the Goods with the Sales Agreement, which will facilitate the process of considering the complaint by the Seller. The above are only recommendations and do not affect the effectiveness of complaints submitted omitting the indicated description of the complaint.
- 7.5. The Seller is obliged to respond to the submitted complaint within 14 days of its receipt. Failure to respond within the indicated period is tantamount to its acceptance.
- 7.6. If the Goods are non-conforming with the Sales Agreement, the Consumer may request their repair or replacement.
- 7.7. The Seller may replace them when the Consumer requests a repair, or may repair them when the Consumer requests a replacement, if bringing the Goods into conformity with the Sales Agreement in the manner chosen by the Consumer is impossible or would require excessive costs for the Seller. If repair and replacement are impossible or would require excessive costs for the Seller, he may refuse to bring the Goods into compliance with the Sales Agreement.
- 7.8. The Seller shall repair or replace them within a reasonable time from the moment the Consumer informs him of the lack of compliance with the Sales Agreement, and without excessive inconvenience to the Consumer, taking into account the specificity of the Goods and the purpose for which the Consumer purchased them. The costs of repair or replacement, including in particular the costs of postage, transport, labour and materials, shall be borne by the Seller.
- 7.9. The Consumer shall make the Goods subject to repair or replacement available to the Seller. The Seller shall collect the Goods from the Consumer at his own expense.
- 7.10. If the Goods are inconsistent with the Sales Agreement, the Consumer may submit a declaration of a price reduction or withdrawal from the Sales Agreement in the cases indicated in Art. 43e sec. 1 of the Consumer Rights Act.
- 7.11. The reduced price must be in such proportion to the price resulting from the Sales Agreement that the value of the Goods inconsistent with the Sales Agreement is in relation to the value of the Goods consistent with the Sales Agreement.
- 7.12. The Seller shall return to the Consumer the amounts due as a result of exercising the right to reduce the price immediately, no later than within 14 days from the date of receipt of the Consumer’s declaration of a price reduction.
- 7.13. The Consumer may not withdraw from the Sales Agreement if the lack of conformity of the Goods with the agreement is immaterial.
- 7.14. In the event of withdrawal from the Sales Agreement, the Consumer shall immediately return the Goods to the Seller at their expense. The Goods should be returned to the following address: MODUS S.A., ul. Karola Szajnochy 11, 85 – 738 Bydgoszcz. The Seller shall return the price to the Consumer immediately, no later than within 14 days from the date of receipt of the Goods or proof of their return. The Seller shall return the price using the same method of payment as the Consumer used, unless the Consumer has expressly agreed to another method of return that does not involve any costs for him.
- 7.15. The Seller’s response to the complaint is sent to the Consumer’s e-mail address provided in the complaint or in another manner provided by the Consumer. In the event of a change in the contact details provided by the complainant during the complaint consideration process, he is obliged to notify the Seller of this. When submitting a complaint, it is recommended to attach a sales document or a photocopy thereof.
- 7.16. In order to clarify any doubts regarding the complaint, the Seller may contact the Consumer via the method of communication provided by the Consumer.
VIII Services provided electronically
- 8.1. The Online Store offers the following Electronic Services: Account, Order Form, Newsletter.
- 8.2. The Customer may use the Account after completing the Registration Form and registering the Account. Upon registration of the Account, the Agreement for the provision of electronic services is concluded. The electronic service of the Account is free of charge. A Customer who has an account on the Google.com or Facebook.com websites may use it to create an Account in the Online Store by connecting the account on the website with the Account in the Online Store. In the Registration Form, the Customer must provide the following data: first and last name, e-mail address, login and password. It is also possible to create an Account when placing an Order by checking the appropriate box in the Order Form.
- 8.3. The Customer may at any time resign from the Account, without giving a reason, by sending an appropriate request to the Seller, in particular via e-mail to the address: sprzeda@modus.com.pl or in writing to the address: MODUS S.A., ul. Karola Szajnochy 11, 85 – 738 Bydgoszcz.
- 8.4. The electronic service Order Form is a one-time, free service. The provision of the service begins when the Customer selects the first Product in the Online Store and ends after the Customer places an Order or resigns from placing an Order.
- 8.5. The electronic service of the Newsletter consisting in sending information via e-mail about the Seller’s Products, services, promotions, offers, campaigns and events is provided free of charge for an indefinite period. The Customer may use the Electronic Service Newsletter after providing an e-mail address and name and confirming the subscription. The Customer may also subscribe to the Newsletter Electronic Service when placing an Order and when creating an Account by selecting the available subscription option.
- 8.6. The Customer may, at any time and without giving a reason, resign from the Newsletter by sending an appropriate request to the Seller, in particular via e-mail to the following address: sprzeda@modus.com.pl or in writing to the following address: MODUS S.A., ul. Karola Szajnochy 11, 85 – 738 Bydgoszcz.
- 8.7. Both the Customer and the Seller may terminate the Agreement for the provision of electronic services at any time and without giving a reason, subject to the rights acquired by the other party before the termination of the aforementioned agreement and the provisions below.
- 8.8. The Customer may submit a complaint to the Seller in connection with the use of the Electronic Services. The complaint may be submitted in electronic form and sent to the following address: sprzeda@modus.com.pl or in writing to the following address: MODUS S.A., ul. Karola Szajnochy 11, 85 – 738 Bydgoszcz.
- 8.9. In the complaint, the Customer should include a description of the problem. The Seller shall immediately, but no later than within 14 days, consider the complaint and provide the Customer with an answer.
- 8.10. The Customer is obliged to use the Online Store, including the Electronic Services, in compliance with the principles of social coexistence, good manners and generally applicable legal provisions. The Customer is obliged to respect the personal rights and intellectual property rights of the Seller and third parties. When using the Electronic Services, the Customer may not provide content of an unlawful nature.
IX. Product reviews
- 9.1. The Customer may voluntarily and free of charge issue an opinion regarding the Product purchased in the Online Store. The opinion may be issued in the form of a rating or review, as well as at the Customer’s own discretion, together with posting their own photo of the Product.
- 9.2. The opinion may be issued only by the Customer who purchased the Product in the Online Store.
- 9.3. The Seller shall take reasonable and proportionate steps to verify whether the opinions are reliable and posted by people who actually purchased the Product in the Online Store.
- 9.4. The Seller shall ensure verification of opinions by enabling the posting of opinions about the Product only by Customers to whom the Seller, after purchasing the Product in the Online Store, sent an e-mail message requesting to post an opinion with a link to an online form enabling it to be posted.
- 9.5. Opinions may be made available directly on the Online Store website, as well as on external websites and the Seller’s profiles in social media.
- 9.6. The Seller is not obliged to post all opinions about the Goods sent by Customers, in particular the Seller will not make available
X Entrepreneur
- 10.1. The provisions of this section apply only to Entrepreneurs.
- 10.2. The Entrepreneur is not entitled to withdraw from the Sales Agreement without giving a reason and without incurring costs.
- 10.3. In the case of Entrepreneurs, the Seller has the right to limit the available payment methods, including requiring advance payment in whole or in part, regardless of the payment method chosen by the Entrepreneur and the fact of concluding the Sales Agreement.
- 10.4. Upon the Seller’s release of the Goods to the carrier, the benefits and burdens associated with the Goods and the risk of accidental loss or damage to the Goods are transferred to the Entrepreneur.
- 10.5. The Seller excludes the warranty for the Goods in relation to the Entrepreneur.
- 10.6. The Seller may terminate the agreement for the provision of Electronic Services concluded with the Entrepreneur with immediate effect and without indicating the reasons by sending the Entrepreneur an appropriate statement.
- 10.7. Any disputes arising between the Seller and the Entrepreneur shall be submitted to the court having jurisdiction over the Seller’s registered office.
- 10.8. The Seller’s liability towards the Entrepreneur is limited – both within the scope of a single claim, as well as for all claims in total, both under the Sales Agreement and the Agreement for the provision of Electronic Services – to the amount of the Price paid, and the Seller shall not be liable for lost profits.
XI Personal data protection
The Seller, as the controller of personal data, processes the data of the Customer or persons acting on behalf of the Customer (in the case of Entrepreneurs). Detailed information, principles and obligations of the Administrator and the Customer’s rights related to the processing of the Customer’s personal data are specified in the Privacy Policy.
XII Extra-judicial resolution of disputes
- 12.1. The Seller informs that in the event of a dispute related to the Sales Agreement or the Service Agreement, the Consumer has the right to use extra-judicial methods of handling complaints and pursuing claims. The use of these methods is completely voluntary.
- 12.2. As part of the extra-judicial resolution of the dispute, the Consumer may:
- 12.2.1. apply to a permanent consumer arbitration court with a request to resolve the dispute arising from the concluded agreement,
- 12.2.2. apply to the provincial inspector of the Trade Inspection with a request to initiate mediation proceedings for the amicable settlement of the dispute,
- 12.2.3. use the assistance of the district (municipal) consumer rights advocate or a social organization whose statutory tasks include consumer protection,
- 12.2.4. use the ODR platform, which serves to resolve disputes between consumers and entrepreneurs seeking out-of-court resolution of a dispute concerning contractual obligations arising from an online sales contract or a service contract.

XII Final Provisions
- 13.1. Customers can access these Regulations at any time on the Online Store website. The Regulations can be saved by the Customer by downloading the Regulations in pdf file format and saving them to the device’s memory or printing them out.
- 13.2. The Seller has the right to change the Regulations. Changes to the Regulations do not in any way violate the rights acquired by Customers before the date of entry into force of the Regulations, including changes to the Regulations do not affect Orders already placed.
- 13.3. In the case of Electronic Services, the amended Regulations are binding on the Customer if the Customer has been notified of the change to the Regulations and has not terminated the Agreement for the provision of electronic services within 14 calendar days from the date of notification.
- 13.4. In matters not regulated by the Regulations, the provisions of generally applicable law shall apply, including in particular the provisions of the Civil Code and the Consumer Rights Act.
- 13.5. These Regulations shall apply from 24.01.2025.
